Affirmative Action Plan Compliance

of Federal Contract Compliance Programs

OFCCP Enforcement Trends

contractors on recent OFCCP enforcement
trends and regulatory initiatives.

considered “applicants,” how to successfully
manage large pools of applicants, what
documentation needs to maintain and/or
recorded for each applicant, and how the
OFCCP enforces its Internet Applicant Rule.

indicator of adverse impact during the
hiring process can lead to an OFCCP failure
to hire case and how proper disposition
information can defend an OFCCP statistical
claim of potential discrimination.
Finally, attendees will learn about OFCCP
latest regulatory developments such as the
Agency’s new enforcement methods for
analyzing compensation and its Active Case
Enforcement initiative. This seminar
is critical for employers who want to stay
up-to-date with current OFCCP developments
in order to avoid potential violations
during an OFCCP audit.

About the Speaker:
Matthew
Camardella is
a Partner in Long Island, New York,
office of Jackson Lewis LLP, and a
member of the Firm's Affirmative Action
Practice Group. He directs the
preparation of more than 400 AAPs each
year and has defended hundreds of OFCCP
audits for a broad range of employers
across the country. In addition, Mr.
Camardella serves as the Practice Group
lead on responding to OFCCP allegations
of class-based discrimination. He spends
significant time counseling clients
about the design and implementation of
company-wide AAP structures, applicant
flow tracking systems, compensation
practices and other complex “real world”
compliance issues.
